That is because we do not make anything in the USA anymore. We don't create
wealth, we redistribute it, often using lawyers to go after peoples' money
because someone slipped on their sidewalks. All of the major consumer
products of the past 30 years have been made in the Far East, and have been
BOUGHT here. VCRs, 35mm Cameras, DVDs, Microwaves, Televisions, Audio
Components.

I bought it before I read the EULA. The terms of the sale are the
terms of a normal transaction of a physical good. In *any*
jurisdiction, that renders an EULA moot, a dead letter. The property
is *mine*, and mine to dispose of as *I* see fit.

the merchandise *before* I plunk down my money will they have any case
at all.
We have not sunk into the depths of corporate fascism enough that
judges will not uphold the First Sale doctrine, even if the PR
departments of the corporations want to make you think different.

1. In Europe, the lawyers still have a lot less power than in the US.
2. My legal liability insurance will cover such a lawsuit. Let them
come, I am not afraid.

I'd expect the EULA on a disposable digital camera would restrict a lot
of 'maximum utilization'. Bad business model or not, a corporate lawyer
can mess-up your life. RIAA thinks "fair use" is theirs to define so get
royalties on blank media. I'd expect the fine print on a new DSLR
includes the right of the manufacturer to confiscate your camera if they
decide your picture reflects badly on their company...

Not unless they bet the company on it. I doubt X-box hardware itself
accounts for 1% of Microsoft's revenues. And if the game sales didn't
materialize to offset hardware costs, it wouldn't take two heartbeats
for MS to drop it, cut their losses.
So it's pretty obvious that regardless of the risks, MS IS making a
profit from X-box, and whatever quantity may be bought for reasons other
than Microsoft's intended purpose don't make any significant dent in
MS's X-box profits.

Still my point is it doesn't really matter if Kodak et al abandon the
B/W market. If the demand is there, someone will supply it.
And photographers living in Britian, Japan, Europe or Australia will
have as much access to it as US photographers ... if not more.
True, if you're living in the "Heart of Darkness", it's going to be a
little harder to come by, but that was true when the big names still
dominated the market.
Less true today I think.

I care. If it comes from some little factory in Eastern Europe, or
Mainland China, no one will want to import it. Not everyone on this list
lives in the U.S.

The other side of it is ... so what? Never heard of a loss leader?
MS makes X-box for $200, sells for $180; sells an average of one new
game a month for 18 months (if not more) @ average profit of $10 per
game ... how much money did they really lose on the transaction?
